What do I do when Child Support paperwork was supposedly never received?
I filed a complaint for child support and was told that the father would receive paperwork informing him of our court date. Its been several weeks already and the father tells me that he still hasn’t received anything in the mail. Will my case be dismissed or delayed if doesn’t show up? I don’t want to pay extra money to hire a process server to have his summons served to him. What’s going to happen if he doesn’t show up to court?

How are you filing for child support? If you are going through CSE it can take awhile due to the overload of cases and low budgeting. Three to six months if the father is in the same state - six to 15 months if the father lives out of state. If you filed on your own, then the father could be receiving the paperwork and just denying that he ever got them. Mailing out information is not ensurance that a person actually received it. This would create a need for a process server, still he could just avoid the server if he knows that you are sending someone after him. If you have proof that he was served and doesn’t show up then he can be held in contempt for non compliance. Basically, your main concern is to establish that the father knows about the legal action and dates. This gives the courts the ability to procede and take any actions necessary to resolve your case.
Who did you send the paperwork to? The father HAS TO BE SERVED period.
I went through the state and filed for child support. They also told me they would send papers out it took 6 months before the father recieved any papers and then it took 3 months after that for a court date. Good luck
Well, what happen to us is the mother recieved the paperwork, but didn’t show. The courts then had a Sheriff serve her the next court date hearing information, and if she fails to show she will have a warrant for her arrest. It sounds like you already have an order, but I know with us, even though she has missed court, when they actually give her the amount she has to pay, she will be paying from the date we first had it processed there (in Jan her state processed it, even though we had processed it months before in our state.)
