(Family Law – Divorce) Which forms do I need to complete to contest a proof of summons which I was never served for – a Default has been entered now I want to contest it?

What should I expect when going into my hearing for Child custody? I’m very nervous
First the dad states that he is not the father of my child on the child support summons and then a few days later he motions for joint custody and to take my child out of the country.He is from another country.We had mediation where he argued with the mediator because she denied his request to go out of the country and then she recommeded six months of supervised
visitation. I don’t have a lawyer at this point

My children’s father owes a lot of money in back child support. Now he has turned the tables on me and has filed for custody of my children. I don’t really know what to do from here, I just got the summons from the sheriff and I definitely don’t know what to bring with me to court. The kids have always lived with me and recently he has started getting them on the weekends… Help…

I live in Minneapolis, MN and am in need of a divorce lawyer that doesn’t require a retainer. I don’t have much $ and want someone that will work with me in responding to a summons and petition and making changes in what my husband in requesting. He owns a home and 401K and is asking for all equity on the home and asking he keep the truck. I know I’m entitled to a portion of the equity acquired on the home, and half of his 401K, but don’t have any $ for a lawyer right now, and I only have 30 days to respond to the summons and petition. What do I do?

I filed a complaint for child support and was told that the father would receive paperwork informing him of our court date. Its been several weeks already and the father tells me that he still hasn’t received anything in the mail. Will my case be dismissed or delayed if doesn’t show up? I don’t want to pay extra money to hire a process server to have his summons served to him. What’s going to happen if he doesn’t show up to court?

Ok so i have recieved a summons that i must submit a written response to a petition to establish visitation in florida, i have 15 days to submit my response and i am at a loss here…….. i am already having financial issues so getting a lawyer is really almost out of the question, i have a free consultation today however im not sure how much they can help being as though i have no money to obtain thier services. My question here is, how would i write my response in reguards to this summons? what information should i include, is there a certain format it should follow? and should i include an offer of visitation or just wait for the actual mediation process to see what the judge proposes? And in your experiances what kind of visitation has a judge granted for a 15month old child? I am all for him seeing his daughter, i have actually talked to him and he seen her this weekend. It was not until all of this that it was brought to my attention that he had a genuine want to see his daughter, now knowing it’s something he wants im open to that. However, i am a bit concerned because i think she’s a bit young to be gone every other weekend for the entire weekend. She’s at the age that im beginning potty training, and trying to get her on a healthy schedule so that she will sleep good through the night. I am concerned that by up rooting her every other weekend that is going to not only terrify her because im all she has known for 15months of her life, and will completely mess up her schedule and get her confused and make things difficult on us when she’s home. If anyone can give me any advice or input as to how this could go, or maybe what has happend in your situation. Or if anyone has any advice as to where i can get legal advice or help i would appreciate it! I’ve contacted legal aide but due to budget cut backs you can no longer get ahold of anyone in the office, and even then they do not assist anymore they just give you advice, they will not help me write the letter.

I have contacted legal aide…. due to budget cuts they are no longer available to help in this situation. You have to call a telephone number that i have been calling all day everyday for 3 days (excluding the weekend and holiday). It’s impossible to get through, and i was already told that even when i speak to them they can only provide advise but will not help me write the response or anything else.
And i am happy he wants to be a part of her life, i think visitation is a wonderful idea. But i think that overnight or i should say weekend visits for a 15month old is a bit overwhelming. She has stranger anxiety and is a very tempermental little girl, if she is out of her enviroment where she feels safe she will not sleep and will likely cry constantly. My job as her mother is to protect her and that’s all i want to do, i want her to be in his life but i want it to be on terms that will not put her through stress and anxiety. Shes not old enough to understand or reason with. Can you imagine being 1 and suddenly being ripped from your moms arms and taken to this strange place with people you don’t know, and you have no clue why your mommy left or when she will be back? that would be devastating wouldn’t it?

so i should include in my response kind of like an offer of visitation? for example stating in my response offering; 1 day visit per week

To make a long story short, about a year ago my wife and I enrolled with CMS (Court Mediation Services) based out of Alabama as a way to ‘legal cancel your debt." A year later, I realize it was a boneheaded move on my part and I should have looked into other options.
CMS said we would receive calls and letters and sometimes summons, especially from Citibank. Well, my wife and I each got one from Citi. No date has been set but the main point of my question would be is it too late to get into a debt consolidation program or something along those lines? We’ve been looking into filing Ch. 13 but want to know if we can still go with a debt reducing program or whatever they’re called. Thanks in advance!
