my wife moved to another state with my kids and filed for divorce. i accepted certified mail with the summons and was not served by a sherriff. I cannot afford a lawyer, but was told by one that they can claim personal jurisdiction. we have no marital assets left, we filed for bankruptcy. I do have a small pension that she could possibly go after. One other lawyer i talked to said they cannot as long as i dont appear in that state. another lawyer completely contradicted that lawyer and said they could easily get personal jurisdiction over me….. please help!!

I am in NY. Husband served me a summons asking for a notice of appearance to avoid default. I filed an affidavit in opposition. Do I still need to serve him a notice of appearance to avoid divorce being granted due to default?
Assuming I file it with the court and serve him both. Do I still need to file a notice of appearance or is the affidavit in opposition enough?

Living in a different state as my soon to be ex husband, he has filed our divorce in Ohio. Recieved a letter saying there is a ‘uncontested divorce hearing’ happening later this month, I cannot make it and have no communication with my husband. I also cannot afford a lawyer or any legal assistance. Please help.

At the time I was employed as a truck driver my husband and I had a verbal agreement as to the division of our assets which were 100% paid for. He sent our two children on the road with me and gave a bogus address for my summons to be sent, I had not even retained an attorney yet. Anyhow he of course was awarded all of the marital assets and child support to boot. The court date was during the time I was gone with our children yet when they ask if he knew how to contact me he told everyone he did not even know where I was. I need to know if anyone can tell me if they know of anyway I can get the judgement reviewed. I’d appreciate any information I can get.

Question Details: I already finished :
1. Proof of service of summons
2. Certificate of Counsel
So what to do next? I’m so confused.
Next is: 1. Mail origianl, 5 check and 2 copies to the court and court will mail me back the stamped with copy of certificate of counsel
2. My friend take that copy of certificate of counsel to him to sign or he keeps that copy???
3. What’s next???

Is there anyone who has gone through a child custody case?
What should I expect when going into my hearing for Child custody? I’m very nervous
First the dad states that he is not the father of my child on the child support summons and then a few days later he motions for joint custody and to take my child out of the country.He is from another country.We had mediation where he argued with the mediator because she denied his request to go out of the country and then she recommeded six months of supervised
visitation. I don’t have a lawyer at this point

My husband signed receipt of summons a month ago, so I could file default today, but I prefer to wait longer. What is my window to proceed later, without having the case tossed out? I am having doubts about the whole thing now, but may still want to go through with it.

based upon the following grounds of Abandonment.What exactly is supposed to go in that blank. Is it a date..or what? Please help!
