My parents went through a nightmare of a divorce that took years to work out. I’d like to avoid the problems they had. The following is a prenuptial agreement that I’ve created.
In the event of separation or divorce:
1. Each parent waives any and all rights and claims to spousal and child support.
2. Joint legal custody shall be 50% for each parent until the child’s 18th birthday.
3. Joint physical custody shall be 50% for each parent until the child is old enough to decide.
4. The terms "custodial" and "non-custodial" shall not apply to either parent.
5. The terms "primary residence" or "secondary residence" shall not apply to either parent’s home.
6. Each parent’s past, present, and future income shall be deemed as irrelevant.
7. The expense of caring for a child and the heartbreak of parent-child separation shall be deemed equal and mutually exclusive.

Joint legal custody — one parent mormon, the other not. What is the Mormon LDS Church Policy for baptizing the children?
The physical custody is with the parent who is not Mormon and the visitation is granted to the parent who is Mormon.
Please advise on policy and procedure if you have direct knowledge or can quote out of the church policy handbook.

My parents are divorced. They have joint legal custody over my siblings, 16 and 14. My mother have full physical custody. My siblings no longer want to live with my mother for various reasons and have been living with my father for the past 3 months. She will not agree to switch over custody. We want to stop child support. Can we filed for child support modification and child custody change?

I am recently divorced. I have a temporary custody order with joint legal custody. I have 136 overnights/year and there are times during the year that I have primary physical custody based on my work schedule. There is no mention in the order about about taxes. I pay the court ordered child support plus half of all daycare expenses. Am I able to claim one of my two children when I file taxes?
I can’t claim daycare because the daycare provider is a friend of the family, not a licensed provider.

Well, my father has legal and physical custody of us, but we are living with our grandmother instead of our father. He comes to visit us every 2 weeks because he doesn’t want to raise us.
Can my mother regain custody of us since my father hasn’t made any attempt to raise us? Is it possible? We are so tire of our parents being part-time parents. We would like to our mother to have us so that we can have at least one full time parent.
So, would a judge grant my mother physical custody? Especially since she has her life together and she keeps us during summer breaks.

I am going through a child custody battle in Pennsylvania , I am going back to court in 2 weeks and the judge is going to decide who the child is going to live with, I am so scared , I love my child and don’t want to not have him live with me.my baby is 5 months old , I provided for him since day one , I have all means of support for him,insurance etc. my ex-boyfriend doesn’t have to pay child support because he doesn’t work, he said that he quit his job because he doesn’t want to pay .and does not have to pay,he said if you take me back for child support again and I work I will just quit again. but he wants physical custody and the child to live with him. So I don’t know what is going to happen. The judge told us at the pre trial that if a man has a child with a women and doesn’t marry her and do the right thing that he isn’t entiled to any custody just visitation. Is this ture ?Does anyone have any advice.

My wife and I have been separated for years. I have physical custody of our son (joint legal). She is out of the country and I want to finally end the documented marriage. Would I be able to file for divorce without her signature, since at this stage I can no longer get in touch with her. Would it be best to not state she is out of the country, simply the fact that I can’t get in touch with her either way. Do I need a lawyer to do this or can I get cheaper help?

I live in Baltimore County Md. I filed for custody of my 2 children in June of 09. I go to a scheduling conference tomorrow morning. The father and I were never married. What happens at this? What should I expect and what should I bring? The children have been in my physical custody since their father left us 2 years and 4 months ago.

I am currently married and living in upstate NY with my 3 children. My husband and I have agreed to divorce but cannot settle custody questions. He says he will fight for physical custody, which I am certain he won’t get (I’m their primary– virtually exclusive– caregiver) but which will probably cost me a fortune to battle over. I would also like to move home to Ohio, about 4 hours from our current residence, because I have no family in NY and have much better job prospects and access to free child care back home. I’m completely willing to abide by any reasonable visitation schedule my husband requests, but he says I cannot move out of state without his consent. Is this true? I’m a stay at home mom; he loves the kids but has never bathed them, taken them to the doctors, made them breakfast, etc. I (we) be living in poverty if I’m forced to stay here. Will family court provide me with a lawyer– he’s cut off my access to the bank account and I don’t know how I’d hire an attorney. Thanks for any help I can get.
