my wife wants a divorce. she has been collecting unemployment for almost 2 years but has a professional degree to work in a high paying job. she has not been actively seeking employment. we have multiple young children and wants physical custody which means child support payments will also be high.should i give her any alimony considering there may also be an adultery issue?

My 3 1/2 year old daughter’s biological father has diagnosed schizophrenia & I have sole legal & physical custody. He has monitored visitation every other week for 2 hours. He usually shows up. However, his mental state isn’t very good & I’m concerned how this will effect her as she is getting older & is more aware of what is going on. Is it easy for me to get visitation taken away due to his mental illness & for the best interest of my daughter? We live in California.

who are in the care of grandparents (physical custody)? The venue is Virginia. Legal custody is shared by divorcing parents and grandparents.

If I have full Legal/Physical custody of child (California is child’s home state), but child is out of control. What do I need to do to transfer custody to non-custodial out of state parent (Texas) who wants to help in getting the child back on track
My out of control definition is that she is lying all the time and is very disrespectful to family and friends (always has a negative attitude when she does not get her way). Yet she is extremely smart and respectful at school.

I am a single dad with 100% legal and physical custody of my two kids. The case was discharged from Juvenile court and now my ex-wife is filing multiple requests with the family court for the custody of the kids. This is harassment and a total waste of taxpayers money. More importantly it is not in the best interests of the children that I keep getting dragged back into court over frivilous lawsuites. I’ve already been told by a lawyer that she will never get them back. I’ve been told that I could file a petition with the court to get her to stop. I don’t know what forms I need or what the term for her is called. Can anyone help me?

forever I’ve had physical custody of my daughter, but up until 4yrs ago, he stopped picking her up and acknowledging her, so my question is because its been that long do I automatically have full custody or do I have to tell the courts?

My husband and I have had his 4 nieces and nephews for 3 1/2 years now and have temporary legal and physical custody of them. Not knowing there was a difference in the two, we thought we had all rights to deciding their well being and what not. We got them because their father is incarcerated and mother is in and out and though expressed interest in getting two of them back, never acted on it. Anyway, it has been since June 18 2006 that we’ve had any contact with thier mother, and have recently learned that we don’t have guardianship and that we can go to the probate court and apply for it but that both parents would have to sign. They said if we couldn’t find thier mother, we’d place an ad in the paper giving her a certain amount of time to come forward. My question is this. Until we do this, what rights does their mother have? Would she be allowed to pull her children out of my home if she wanted to? She is wanted so I know she would go to jail, but could she have them removedfrom us

my main concern is physical custody of my daughter, i want her to be with me more time than with her dad, he’s not very good at taking care of her but I also do not want to deprive her of being with her dad. Also would this be cheaper as far as lawyer fees if i file for child support and then file for a divorce with a lawyer? thanks.

My ex-boyfriend and I broke up about 8 months ago and I have physical custody of our son. I’m afraid that if I file for support he might try to take our son from me and I’m wondering if I need to file for custody or not. His name is on the birth certificate as the father, but he has not done anything to support our son since the split aside from the occasional visit when my son spends the night at my mother’s house.
