My question involves bankruptcy in the state of: California

Chapter 7:

I’ll try to simplify the problem by putting it into an example.

Example: If a couple gets married in the 2001. Then, 3 years later (2003) the husband files for bankruptcy. There are 3 properties, of which one is under the name of the husband and wife(Title under the name of both, not mortgage) . One under the name of the wife which is paid in total(Title under wife name, not mortgage). The other property is under the name of the wife and an associated(Title under wife and associates name, not mortgage).

The husband only mentions the property for which he shares ownership with wife. He doesn’t mentioned the other two properties under the name of the wife. He declares under perjury of law that the only asset he has is the joint property, nothing else at that point.

Can his statement later be use to impeach him in case of a divorce?

Can he be convicted of perjury?

Does he have a legal claim to the other property he failed to claim?

or

Can he be ask: Did you commit perjury by failing to disclose all property or you have no interest in the other properties?

1. The marriage was solemnized under the Hindu system and all that we have is photographs. We had not got the same registered. The lawyer says that because of this the case may be delayed.Marriage was in Pune and place of residence also in Pune. We have Ration Cards in which husband and wife relationship is mentioned.

How to solve this difficulty?
2. Both of us have come to conclusion that divorceis the best course of action and that too quickoly. Are there any exceptional
circumstances in which the mandatory period of 6 months can be reduced to say 2-3 months?
3. What is the role of marriage counsellors that the court appoints? Can’t we tell them that we have had enough and we do not want to go in details and we want the divorce fast and quick[ This time we have not even told anything to our relatives]. Earlirer relatives used to patch up for some time which used to go haywire in a few months.

Divorce help?

I am 27 and my husband of almost 3 years is 24. we moved from WA to CA 4 years ago and it has been a very hard time for me. He told me when we first started dating that this is where he wanted to be and what his plans were for his career and every thing, but he wanted me to be with him so i moved away from ALL of my family and friends. It was very hard for me because i had never been without my support group, and all i had was my husband. He is very dedicated to his job and we had some really great times, but over the years, my unhappiness and lonliness, along with the sudden death of my father really made me an unhappy person. It became obvious that we had grown into different people, and were wanting different things. My husband just last week told me that the love he feels isn’t what he should feel for a wife. he loves me as a person and his best friend, but we have grown apart as husband and wife. And he also knows that i would be happier being back with my friends and
family, which i would. I haven’t made any close friends down here. My husband has decided that the best thing would be for us to split up before we have kids because we just want different things in life. He said that he will not turn his back on me and that I am his best friend and he is still living at home, just in the other bedroom. In his mind he has already moved on (there is no one else) and our marriage is over. But this is a huge shock to me. I am so scared to not have him in my life every day and have the affection we once had. We truly are best friends and are trying to make this as easy as possible and still get coffee together and joke and stuff. I just feel like someone has died, and although i know that we will still be in each other’s lives, this isn’t how i wanted things to end up. I wanted babies and to grow old with this man.
Has anyone gone thru something similar and can give me something positive? No mean comments please…

My brother in law owns an LLC business. He is sole owner.
My sister is divorcing him, and she has been told that the busines is classed as a marital asset and she has right to part of the profits.
Want we want to know is, the business debts..should that be included in marital debt, or should it be separate as the business is an LLC and should in any other legal issue be separated. Meaning the LLC is liable for its own debts, protecting the personal assets and you.
You see their personal marital debts is low, they have equity in their other assets.
The business however has debts, like suppliers and whatever, can her husband put all debts in a pot, or can she ask for it to be separated from the personal debt?
If the LLC cannot pay the debts off..surely the LLC is liable and not the husband and wife?
Please could someone tell me the rules on this? I cannot find information about it anywhere thank you
The LLC is a corporation. He is 100% shareholder. Yes he has signed personally for credit etc
This State is an equitable State.
He filed for LLC and as a corporation to save their marital assets and vice versa.
My sister can’t afford a tax attorney just yet, but wanted to know some information about it beforehand.
She has been told she does have a claim in the business but wondered whether the debt like what they owe suppliers etc should be taken all as one debt in their divorce?
He is classed as the owner, and CEO of the business.
There is nobody else, just the employees.




Questions about filing for divorce in AZ?




If anyone is from AZ and has been through this and knows the answer, please let me know. I can’t find my specific question anywhere on any of the court websites.

If both the petitioner and the respondent (husband and wife) show up to file the papers for the divorce and everything is in agreement, can the court serve the respondent in person right then and there? Or will they still require both parties to leave and have the respondent "served" somewhere outside the courthouse?




Can creditors seize my property?




A creditor of my husband is sueing him for a credit card debt. My home is homesteaded, and any tangiable assets we have are jointly owned, just me and my husband. Can they take it anyway, even though the property also belongs to me? I live in Florida.

The titles to everything (personal property wise) read as OR instead of AND, but the assets are marital property, purchased with commingled funds, from a joint checking account, and as husband and wife. Does this fact that we are married protect me from the seizure of what is my property also?







If name is not on deed, would this still be considered marital asset?
Husband and wife are not together anymore. Wife and new boyfriend bought house together but her name not on deed. Wondering if her name is possible to be on mortgage loan?







Intimacy is part of relationship between husband and wife or boyfriend girlfriend thing. But why is it most men ( married or single) doesn’t know how to approach or initiate romance or sex to their wife or girlfriend?







Here’s the situation: A husband and wife have joint ownership of their marital home. She, quit claims her portion to him because they have a spat. Years later they divorce; because Florida is Under the Equitable Distribution scheme, marital property is fairly divided between the parties. 1). is the marital home out of the equation when they split their assets? 2). Let’s say the husband(who holds the deed) dies. Does the wife get the home, even though she quit claimed it over to him?
