Divorce with children?

If one party has already been granted sole custody of the children due to the other parent being named unfit, does a contested divorce still need to be filed to state the custody information of the children? Or does the custody decision superceed the divorce and an uncontested divorce can be filed. Also, in Georgia, the divorce laws state that the parents must attend a parenting class before the divorce is granted. If one of the parents has been awared sole custody of the children for 6 years now, does that parent still have to attend the parenting seminar.

Common Law Divorce in Tennessee?




I have a question about divorce laws. This is for the state of Tennessee. If two people split up about 15 years ago and don’t live together, but never legally divorced, is there any statute that allows for dissolution of the marriage such as common law allows for two people to be legally married after they live together for so long?
I understand Tennessee is not a common law marriage state. My question, though, is if there are any similar statutes that would allow a marriage to be dissolved?

I live in Buchanan County, Missouri. My father and step-mother are getting a divorce after 15 years. They have 3 kids around the age of 13 together. My dad has owned this house and had it payed off since the time it was built, and that was at least 10 years before he met my step mother and they got married. It would seem that its a clear cut decision that he’d get the house, but it’s probably not that simple. Technically I don’t think the house is a marital asset since it wasn’t purchased subsequent to the marriage, so I wouldn’t think it would be included in the division of marital assets and liabilities. But I’m not sure if it’s that simple. I’m going to find out for sure in a few months anyway, but I was curious as to your interpretations.

If there are any moral issues that would affect the judge’s decision feel free to tell me, but not particularly looking for moral guidance myself.

They were very successful in taking over legislatures. If there is sanctity in marriage, shouldn’t they work to change the divorce laws to get rid of no fault divorce?







You go to the state you were married in or the state you live? Which divorce laws will effect you the state you were married or where you live?







I don’t know how the divorce laws vary but we have lived in florida and wisconsin and own a small home in both places. I need to find out without spending money to ask an attorney in both places.







In other words, the divorce might or might not happen, but it seems like it probably would, and meanwhile you have to decide whether to move to Oregon or Kentucky, and one factor you want to take into account is which place is more likely to give you a more favorable divorce, with kids and retirement accounts and such. You would rather keep full or joint custody and not have to pay support, so you would want to look up the divorce laws of each state. But, overall, considering everything, which state do you think would be better?
