Common Law Divorce in Tennessee?




I have a question about divorce laws. This is for the state of Tennessee. If two people split up about 15 years ago and don’t live together, but never legally divorced, is there any statute that allows for dissolution of the marriage such as common law allows for two people to be legally married after they live together for so long?
I understand Tennessee is not a common law marriage state. My question, though, is if there are any similar statutes that would allow a marriage to be dissolved?




What the cheapest way for a divorce?




My husband and I are trying to get a divorce without spending so much on lawyers fees. We have a two year old daughter and we AGREED to have split custody of her and we also AGREED to what goes to who as of our belongings. I’ve heard of something called dissolution and kinda understand it. This is our first marriage and will be our first divorce. We are currently living in South Carolina, so I don’t know to much about how the ground laws for divorce is here. I believe that we had to be separated for a year, or proof of adultery. We’ve only been separated for almost 2 months. What can we do to divorce the cheapest way, as in a dissolution?
Pure? What State were you living in? I’m hoping it’s the same for South Carolina. lol

Property terms after marriage?




I am the sole owner of the house me and my wife own. We are getting a dissolution and there is no equity in the house. I understand the legal laws for Ohio regarding splitting of equitable asset in half. My question is my (wife) wants 33% of the equity earned if I sell the house within one year of the judgement ending. Is she entitled to any equity once the dissolution / divorce is over and also if I dont agree to this proposal whats the chances the court would uphold this request. Also let me point out that she walk out for 5 months before asking for the dissolution and has already moved all the individual and marital assets aggred on out of the house.







We have been seperated for 2.5 years and live on opposite sides of the country. He still lives in our house there with his new girl and baby. Im at my parents house 1000 miles away. He doesn’t want to sell and refuses to give me any compensation for the house. He claims he doesn’t have any money to give so i’m expected to just walk away from it. He is the one handling the dissolution paperwork for the marriage and ive never seen any of it. I have a feeling hes trying to screw me and im not sure my rights on the house. I asked for ,000 to take my name off the house deed and the car that he drives. What should I do? I cant really afford an attorney at this point.
See, he lied to me and told me he had filed for a dissolution 6 months after we seperated, which was Louisiana Law. Then he was hard to get a hold of after that…and everytime i could finally find him hed have another excuse for why is was taking so long. He doenst have an attorny because we were just going to hash it out between ourselves. But the only paperwork ive been sent is the one to agree to the filing of the divorce….nothing about splitting property. He claims the judge has our paperwork on her desk and we are just waiting in line at this point. He initially gave me 00 when i left, that was supposed to be a first payment of ,000 that he agreed to give me. Now he refuses to give me anything. I signed an "Act of Donation" paper on the house that states its subject to a community settlement between the parties.




Florida Divorce Question?




My stepdaughter and son-in-law were married about 5 years ago while he was in the country illegally. After some time and after the birth of their son, they agreed that it would be best if he obtained legal status, so he was required to return to his country (Mexico) and wait while the immigration process ran its course. During that 20 month period their relationship was strong and she visited him in Mexico with the child several times. Only a few months before he was to return (October 2009) she met another man and cheated on her husband, and she has maintained this relationship to date. When he returned with as a legal US resident she kicked him out of the house. He had no money or job at the time. My wife and I took him in of course and he has been living with us since then. He has been working sporadically. I’ll skip all the mean and lousy things she has said and done to him, but it should be noted she was recently diagnosed with Bipolar Disorder. She is only reasonable once in a while. She is a Registered Nurse and makes decent money (perhaps 60k/yr). She does have 2 other children (11) from previous married (she receives child support from their father) and owns a home, but is upside down in that home.

A few days ago she filed for divorce/dissolution, sent him copies of the paperwork and asked him to go to her attorney’s office to sign. Most of the terms are standard and reasonable, including shared visitation of their child and a division of assets, but some modifications are needed. Also, she would keep the house, and she is requesting 0 a month child support. While my son in law is completely willing to support their child and would be happy to pay even more if he could, he simply does not have that kind of money. He is living with us, works as much as he can which varies a lot, and as a house painter is not making much money. He is in no position to pay very much in child support until he can save some money, get out on his own, and obtain steady work. We know we can use the Florida Child Support worksheets to have the amount modified, at least for now. The big questions we have are:

-Now that she has served him with the papers, what exactly must he do to have changes made? Keep in mind, neither he nor we can afford an attorney, at least not more than a few hundred dollars, perhaps for legal assistance.

-Can he deny her filing and file a petition on his own? If so, can he sue her for Infidelity and obtain any compensation from her (again, he may not do that, but we want to know what the law is)

-Is there a time frame for him to respond, and if so, what is considered a “response”? Can he refuse to sign the divorce papers and not have it go into effect by default?

What other advice can you provide?

I am trying to file for divorce or dissolution, and I have downloaded forms from a website, which seem to be really confusing, and I have checked other sites, most seem to be expensive but all still seem confusing. I would like to know… Which forms are needed exactly for an uncontested divorce in Ohio with children but no assets?







I would like to hear about any similar groups that address issues concerning children of divorce. I am currently in the middle of a divorce. I have a small child who will be affected adversely by the dissolution of her parents. I want to be the best parent I possibly can. I know that there are many parents who share my concerns and would like to exchange ideas on raising our children from broken homes. I would appreciate any ideas or suggestions. Thank you
