Divorce with children in NC. Need advice!?




My friend has four children with her husband of 12 yrs. She is now wanting a divorce. The problem is she has no job and cannot get one until she has child care (which she can’t afford til she has a job). She also cannot afford a lawyer for the same reason. She has never held credit to establish a credit history so moving into her own place is out of the question. Her husband doesn’t want the divorce, won’t cosign for an apartment, won’t move out and won’t get a lawyer. So my question boils down to: what does she need to do to take the kids out of state so she can move in with family and file from another state?







Could anyone point me in the right direction on how to make things legal and recognized by the court in a case of two parents who are NOT married, agreeing on child care and visitation where the amounts and visitation schedule is clearly written out on a form. How would I go about doing this…Where do I start? Any help and suggestions is very helpful.







How does the court order child support in a joint custody relationship when one parent is making a bulk of the income, and is responsible for sharing a payment in rent, paying all or most of child care, and other expenses due to other special needs for the child? Are all of these expenses included within a fixed amount of child support based off of income, or is it likely to increase because of these extra responsibilities?

Ok. I’ll try to keep this as concise as possible but it’s a long one. As of 2007 my boyfriend/husband (further referred to as b/h) filed our taxes together and started claiming common law marriage. As far as Colorado goes, we’re married now. Things are falling apart and he said he doesn’t want to be with me anymore. We have a 16 month old son together, and just got a new car for me with the assumption we would still be together to help each otherr pay for the bills. In the past we have broken up and gotten back together, but the relationship has never really been a happy one, and I really don’t want my son to see us fighting, so though one part of me thinks we will prob get back together, I think it might be best if we didn’t.

Now here’s where things get hard. Even though I have a decent paying job, after doing calculations I’m not sure I’m going to be able to afford all the bills AND a new place alone with my son! I know this might sound stupid but is it mean for me to get child support when he has said he would pay for half of his child care and half of his "bills". I used a colorado child support calculator and it says he’ll owe my son, monthly, more than what he’s saying he’ll give me. And if things go sour I don’t want him to go back on what he says etc, even though "at this point” he’s trustworthy.

My next question is what do I do first? and how do i do it?! I dont know how to file for divorce or where to go to do it, how much it will cost me. How to get joint legal custody with my son staying with me, and how to get the child support. We are deciding to stay living together until our lease is up in June (yeah, lame right?) and splitting all the bills but I’m scared if I start talking about child support and custody he might try to get all that before I can figure it out! Help. Please give me any advice, any information, comments, anything you can manage. Thank you ahead of time!!
Yeah the thing is he tends to break up with me yearly lol. I would love to work things out, but that needs to change. I’m just worried about making ends meet and surviving this!!!

How is Child Support Calculated in California?




I am beginning the divorce process. I have a 1 year old and will have the majority of custody. What is included in the child support calculation. I had a consultation with an attorney and she used a program to give me an estimate. She asked for both our monthly incomes before taxes? Does this factor in special need expenses like child care, clothes , living expenses and extracuricular activities. Or is it strictly based on the spouses income?




Child Support?




Two questions about child support in California. My daughters mother (we were never married) recently lost her job. She is now on unemployeement, but is still requesting that I pay my half of child care. In addition, she is asking that my child support payments go up to reflect that she is now only getting 00 a month for unemployement. Can she do that even though she is not working?

Second questions, when i have additional children with my wife, how much can i expect my child support payments to go down to the mother of my daughter? What if we have two additional children?

Child Support?




My boyfriend and I live together and are planning to get married and start a family. He already has a boy from previous marriage and he pays child support, which I think he should. We have enough to pay the bills, housing etc. My concern is if we have a child, he won’t be able to me help out financially since a good amount is going to child support. I guess i’ll be the breadwinner and I’ll have to pay for child care and other expenses. My question is, has anyone been in this situation? if so, how did you manage? Should I get a 2nd job, should he get 2nd job???







Im a 22 year old mom of two little boys and have been married for 3 years, and with my husband for 6. We recently bought a house and I thought things were fine until he left his family 2 months ago for another girl. Now that they aren’t together which i knew was going to happen he wants me back but I have moved on and I want a divorce asap! I don’t have a job because he made enough for me to stay home with our sons. He is giving me money and its enough to support us but I just want to be over with this. I really don’t have 300 dollars to get a divorce right now. If i saved for a while I would but he isn’t giving me money because there have been overdrafts from bills that automatically come out and he is threatening to not give me another penny. I live in Az and I really need help paying for the divorce.
I think I may need legal aid too because If he fights me on custody. What should I do?

Our house is also foreclosing because I cant make the payments I only pay for utlities.
I would love for helpful advice. I will get a job and I have a really good one lined up but where I live it would be to far of a drive so as soon as this house up for forecloser which should be in 6 months I will get that job but when I spoke to many people they told me to wait it out and take care of the boys and wait till I file to get him to pay for child care.
I asked about a divorce not critisim about getting a job. I can take care of supporting myself and children I just need a fast and easy divorce.







I don’t want a divorce but I would like a legal separation…we have problems and will be living apart, but for reasons of child care, need it legally handled. Can I do it myself, can I get forms at the court house or must I buy some package online, and are there residency requirements. I am a stay at home mom, so hiring a lawyer is kind of out of the question. Any help would be appreciated!
