In 1990, when I was a child of ten, and my brother was 5, our parents divorced and had a heavy battle for our custody. Due to my mother’s mental conditions, the judge had requested evaluations of our immediate family and of my father’s parents. The evaluation was then typed out (and I have possession of it) with quotes with each of our names on top. My family’s last names were all misspelled. Only thing that is wrong with the paper is they quoted my mother’s parents and not my father’s parent’s names. My mother’s parents were not involved in the custody battle. Since the evaluation consisted of only my father’s parents how the name difference was over looked? Is this a big mess up? If so could my brother and I be rewarded for our suffering due to their mistakes?
the missspelling of the names is not the actual problem, it was the fact that my father’s parents were evaluated, not my mother’s parents. but the last name they used and qouted were my mother’s mother and her husband who had nothing to do with the evaluation in the first place. they used and quoted the wrong names therefore quoting the wrong people.

My ex SIL took her kids to be seen at a hospital for possible neglect. More or less she was fishing for an excuse to blame and get full custody back. They gave the children shots and she consented for treatment. I know that she is the mother but with only having visitation rights (my brother has full custody) can she legally do that??

Just curious! Some people say no matter what the contract say the judges makes the final say in divorce. Does a prenuptial even work in court? My brother is getting a divorce tomorrow he did set up a prenup before they got married I’m just very curious.

Three brothers, my husband being one. Father dies and leaves property in division to the three sons. There is a main house w/pool and a guest house w/pool. One brother buys the other two brothers’ interest in the house and acreage. The guest cottage is inhabited by a "relative" and his wife who have lived there for over 35 years. Formerly, the sons’ father had inherited the house and acreage from his mother when she died, but her will specified that the "relative" and wife had usufruct of the guest house until death. The "relative" claims that his mother presented him with two ____ which have been at their pool cite for over 35 years. The son who purchased the property and moved onto it in the main house removed the ___s from the "relative’s" pool. The "relative" has asked for them to be returned, but the brother and his wife have refused and believe the ___ s are their property. The "relative" has asked both of the other two brothers (including my husband) to look over the list of assets (furnishings, etc.) that were described in the distribution of assets list. The ___s are not listed. Now the "relative" wants the two brothers to swear to an affidavit that states they believe unequivocably that the ___s belong to the uncle and wife and should be returned. There has been a lot of strife in this family over the years having to do with property, money, etc. Now, it’s coming full circle, and even though my husband and the other brother believe the ___s do belong to the "relative", they think by signing the affidavit before a judge that in essence, WWIII will break out and there will be a terrible aftermath having to do with family peace. It seems very out of character for the brother to refuse the return of the ___s based on the information he has been provided, but his wife is a different story. Any suggestions would be GREATLY appreciated. Sorry so long and complicated. The truth often is.
The property has all been split three ways among the three brothers. The "relative" living in the cottage/guest house is not an heir. He and his wife have use of the cottage for life..that’s it. They don’t own the cottage, but they do own the contents, i.e., their furniture, clothing, etc. They claim the ___s were a gift from his mother many years ago. The brother who is now living in the "main" house (because he bought the other two out) is the one who took the urns from the pool at the guest house.

I want to continue to live with my G/F as I have for over 6 years. But my children of divorce want to move into a house my older brother has provided. I visit there often, and stay overnight often. May these children 21, 20, and 14 live there with my often stays, without my declaring that I actually live with them?

I have been with my Fiance for over six years we are planning to get married next year. We’ve recetly brough up prenuptials, we though it would be a good time to discuss it because his brother, who is also getting married next year has told him that he and his fiance have decided to sign a prenup. Now his brother is trying to convince him to do it. you know … "to protect the both of us" well we’ve never really though about it…. now we are and i kinda think its not neccesary. Its not like we are millionars and own estates. we have been together since we were in high school and come along this far in life w/ eathother. He is a correctional officer and i am finishing my education achieving my BA in communications. We stood by each others side and help each other get to where we are today. We have helped eachother financialy, sacraficed opprotunites for another etc. In the event that we do divorce i think we owe each other that much. 50/50
is that stupidity or what? waduya think?
