You can do it for free but I would get a lawyer to prepare it. It will depend on the lawyer.
Good thing is to put what percentage of community property goes to whom in the event of cheating, irreconcilable differences, abuse etc. Also to clearly state what was yours before the marriage is going to remain yours if the marriage ends.
Don’t know how to ask them for one…you have to know your fiance.
If you’re worried about the cost, I’m guessing you probably don’t need one. The reason most people get a prenuptial is to protect pre-marriage assets from divorce proceedings. If your individual net worth isn’t more than at least $50,000, then I’d say you don’t need one.
However, if you do want a basic prenuptial agreement, you can write one with your significant other. As long as you both sign and date the contract, it’s a legally-binding document.
Of course, two amateurs writing a contract will probably leave crazy loopholes that your significant other might exploit - so if you’re serious about your prenuptial, I’d recommend talking to a lawyer. The lawyer fees for a prenuptial range from about $600 - $1,000, depending on your unique circumstance.
