How much child support can I get for my 1 yr old?
The father of my one year old denies that she is his daughter. He moved to canada and got married, I live in the U.S. How do I get a paternity test to make him pay child support? He refuses to take a DNA test. Also, if he does pay child support - how much would it be? Would that could as my earned income if I apply to other state programs to help?

Here in TX. you would get 20% of his income, for one child,
and the court will enforce a dna paternity test and if it is his, he will have to pay for the dna test,if he does not pay court ordered c/s,
his credit gets messed up,cannot get a passport, lien on property, garnishing bank accounts, and finally jail time.Don’t mess with c/s in TX.
It does vary from state to state though, and being your ex is now in canada, you probably will have ALOT of trouble getting him to pay up.If he doesn’t pay and he ever moves back to the U.S, he will owe a huge amount of back pay, and you will get his income tax refund when he files. You can claim child support as another source of income when applying for credit cards, state programs.
I pay c/s, that’s how come I have some much info.
and another piece of info, please, please, make sure you know 100% child is his,you don’t want to enforce a dna test and be humiliated.
child support PLUS your income is a factor in determining how much assistance if any you can get
paternity testing can be enforced with a attorney /courts
child support is dependent on how much he AND you make per week/month
Talk to a lawyer. Child support would be a percentage of his income, but who knows if he can be forced to take a paternity test in canada.
I know how you feel. I am in the same situation. the father got married too. and it is kinda of weird cuz we did plan our baby together and now he doesnt want anything to do with her
Since he lives in another country it may be something that will not be made to happen since he is not under us laws. I would call your local child support office and ask if they can do anything about this since he lives in another country!
YES… they count it towards UNEARNED income for state programs.
You have to have family court settle that, it’s dependent upon both parties incomes. As for Dna Pat test, it also can be ordered. This stuff wouldn’t happen if people were responsible.
the amount of child support is based on how much the absent parent makes
you go to the child support office in your state (usually friend of the court) and file for child support. You will need his address so you can have the paperwork served to him. If he is not on the birth certificate and did not sign an acknowledgment of paternity, the friend of the court will order a paternity test There is a calculator that the courts use based of the father’s income that determines the amount of child support that should be paid.
