does a prenuptial agreement protect a spouses business created after or before a marriage? or both?
i heard that prenups can protect your business, but is this limited to when your business was created?

A prenuptial agreement is, in essence, a contract. And you can contract for pretty much anything provided that there is an offer, assent, clear teams, consideration, and acceptance.
You can contract for assets already owned, or even assets not yet earned. They can protect your business, or any business that isn’t even created yet. They can be as wide as narrow as you want, as long as the terms are clear and unambiguous.
Also, people need to stop giving definitive legal advice on here. Newsflash: contract law is state law. Even if you are correct regarding the law, that’s the law as it pertains to your state, and not necessarily the asker’s state.

prenup in basic terms means that the assets brought into the marriage and bought during the marriage, signed by that particular party will remain theirs..
so if the business is owned by the husband for example it will remain his weather it was opened before or after..

A prenup is an agreement on assets. It depends on the prenup… You can make it as narrow or as wide as you like. Everyone has different circumstances. Its not one size fits all.
A prenup only protects a business that was already in operation before the marriage. However, you can sign a post nup that covers the business created after the marriage. See a lawyer before doing this as it can also change your tax status.

It depends on the state the business is in. But it can protect a business because the details of the prenup are clearly stated and agreed on beforehand. If the business is kept out of any divorce settlement, then that should be clearly stated and agreed on by both parties.
